Skywolf Games Studios - Terms of Service

TERMS OF SERVICE

Welcome to Skywolf Game Studios ("Skywolf," "we," "our," or "us"). Please read this Terms of Service ("Terms") carefully before using our services, games, websites, and related content (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using our Services, you agree to comply with these Terms, which may be updated by us from time to time. Any changes to the Terms will be effective upon posting, and your continued use of the Services after such posting constitutes your acceptance of the updated Terms.

2. Use of Services

2.1 Age Restrictions: You must be at least 13 years old to use our Services. If you are under 13, you may use our Services only with the consent and supervision of a parent or legal guardian.

2.2 User Accounts: Some of our Services may require you to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Prohibited Activities: You agree not to engage in any of the following activities while using our Services:

• Violating any applicable laws or regulations.
• Impersonating any person or entity.
• Using the Services for any illegal, harmful, or fraudulent purpose.
• Disrupting or interfering with the functionality of the Services.
• Engaging in any activity that could harm our reputation or the reputation of our partners.
• Using automated systems (bots) to access or interact with our Services.

3. Intellectual Property

3.1 Ownership: All content, including but not limited to games, artwork, graphics, audio, and text, provided through our Services is the property of Skywolf or its licensors and is protected by intellectual property laws.

3.2 License: Skywolf grants you a limited, non-exclusive, non-transferable, and revocable license to use the content provided through our Services for personal and non-commercial purposes.

4. User Content

4.1 Your Content: You retain ownership of any content you create, submit, or upload to our Services. By submitting content, you grant Skywolf a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and distribute the content for any purpose.

4.2 Prohibited Content: You agree not to upload, post, or share content that is illegal, defamatory, abusive, obscene, or otherwise objectionable.

5. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in the Privacy Policy.

6. Termination

We reserve the right to suspend or terminate your access to our Services, without prior notice, if you violate these Terms or engage in activities that could harm our Services, users, or partners.

7. Disclaimers and Limitation of Liability

Our Services are provided "as is" without any warranties. Skywolf shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Services.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

10. General Creation Guidelines Annex 1 of 2

Upon completion of Work, Creation of Assets, Games, Software, Designs Etc therein. All digital assets and/or Relatable Goods and end-user Results will be turned over to Specific Associated Project Client pertaining to and including removal of any and all Creator Company and Original Owner Branding which shall not be removed unless 50% of Agreed Payment has been paid upfront or in full for rendering of professional related services. Failure to pay will result in Creator Company and Original Owner retained rights of Work, Creation of Assets, Games, Software, Designs, Etc that were created for Current Project in question. If for any reason in the event Client is not happy with any of the work, additional work may take place upon client's request to rectify/fix any problems which may incur but not limited to additional charges not to exceed aforementioned hourly rate unless Creator Company and Original Owner is found specifically at fault with proof of liabilities in which there is No Charge or if Creator Company and Original Owner opts to waive said Fees for Services rendered if deemed as such. Should client remain unhappy with end result, Creator Company and Original Owner may further opt to honor a 50% refund with no questions asked within valid reasoning which only applies if Services have not exceeded, abused, or otherwise withheld any given unreasonable work that required further Services.

In the event that a Project and it's Client or Company become unpleasable and or a stalemate after several iterations of project fixes to appease and resolved the situation.  The Creator Company and Original Owner Branding may opt to Immediately End the Contract due to unpleasable and insatiable means based on unfair grounds if unfairly kept. This is a direct Breach of Contract and usually results in No Refund with a Fee if not paid. A client will have a certain amount of time to pay off what is owed In Full to obtain the Current Files for their associated Project. Failure to pay this in a fair amount of time, usually 7-14 days, will result in further Fees, default of project ownership to its Creator Company and Owner along with an override to Hourly Rates if Fixed to recover expenses and additional labor if any occurred during the time. This can be circumvented if paid in Full to resume work if agreed upon furthermore.
